1Amending the act of November 10, 1999 (P.L.491, No.45), entitled
2"An act establishing a uniform construction code; imposing
3powers and duties on municipalities and the Department of
4Labor and Industry; providing for enforcement; imposing
5penalties; and making repeals," further providing for
6applicability of act to swimming pools and spas.

7The General Assembly of the Commonwealth of Pennsylvania
8hereby enacts as follows:

9Section 1. Section 104(f) of the act of November 10, 1999 
10(P.L.491, No.45), known as the Pennsylvania Construction Code 
11Act, is amended to read:

12Section 104. Application.

14(f) Application to swimming pools and spas.--

15(1) The provisions of this act as they relate to
16swimming pools and spas shall not be applicable to those
17constructed or installed prior to the effective date of this
18act.

19(2) All swimming pools and spas constructed or installed

1after the effective date of this act shall be governed by the
2requirements of this act, including section 503.

3(3) A swimming pool or spa subject to paragraph (2) may
4not be filled with water until the barrier requirements of
5this act are met and during construction of a swimming pool,
6temporary barriers shall be erected as required by department
7regulations.

8Section 2. This act shall take effect in 60 days.
