AS AMENDED ON THIRD CONSIDERATION, IN SENATE, JUNE 4, 1996
AN ACT 1 Amending the act of June 19, 1931 (P.L.589, No.202), entitled, 2 as amended, "An act to promote the public health and safety, 3 by providing for the examination and licensure of those who 4 desire to engage in the profession of barbering; regulating 5 barber shops and barber schools, and students therein; 6 regulating compensation for service rendered; conferring 7 certain powers and duties on the Department of State; and 8 providing penalties," further providing for the supervision 9 of shops. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Section 12(a)(1) of the act of June 19, 1931 13 (P.L.589, No.202), referred to as the Barbers' License Law, 14 amended December 7, 1994 (P.L.855, No.123), is amended to read: 15 Section 12. (a) (1) Except for shops licensed under 16 section 13(b) and [one barber] for one-barber shops, [barber 17 shops] which shall be [under the immediate supervision of] <-- 18 OPERATED BY a licensed barber, [who has been a licensed barber <-- 19 for one year,] all other barber shops shall at all times be <--
1 under the immediate supervision of a manager-barber. In [no <-- 2 barber shop shall there be more than one student] for each <-- 3 barber-teacher or manager-barber in the shop BARBER SHOPS WHERE <-- 4 STUDENTS ARE SUPERVISED BY A MANAGER-BARBER THERE SHALL BE NO 5 MORE THAN ONE STUDENT PER BARBER SHOP. IN BARBER SHOPS WHERE 6 STUDENTS ARE SUPERVISED BY A BARBER-TEACHER THERE SHALL BE NO 7 MORE THAN ONE STUDENT PER BARBER-TEACHER. In no case shall there 8 be more than three TWO students per barber shop. All barber <-- 9 schools shall keep prominently displayed at every entrance to 10 said school a sign reading "Barber School." Any copartnership, 11 corporation, or person desiring to operate or conduct a barber 12 shop or barber school, shall first secure from the board a 13 license to do so, and shall keep the same prominently displayed. 14 Both the fee for registration of each barber school and the 15 annual renewal fee shall be determined by regulation. The board 16 may pass upon the qualifications, appointments, and course of 17 study in said school, which shall be not less than one thousand 18 two hundred fifty (1250) hours and not less than nine months. 19 All barber schools shall have not less than one licensed teacher 20 for every twenty students, and in no case less than one full- 21 time teacher, who shall be in attendance at all times during the 22 hours the school is open for instruction. This section does not 23 prohibit an owner who is a cosmetologist from employing a barber 24 without the requirement that a manager-barber also be employed. 25 * * * 26 Section 2.
