                               A JOINT RESOLUTION

     1  Proposing an amendment to the Constitution of the Commonwealth
     2     of Pennsylvania, further providing for emergency legislation
     3     and for emergency declarations by the Governor.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby resolves as follows:
     6     Section 1.  The following amendment to the Constitution of
     7  Pennsylvania is proposed in accordance with Article XI:
     8     That section 17 of Article VIII be amended to read:
     9  § 17.  Special emergency legislation.
    10     (a)  Notwithstanding any provisions of this Constitution to
    11  the contrary, the General Assembly shall have the authority to
    12  enact laws providing for tax rebates, credits, exemptions,
    13  grants-in-aid, State supplementations, or otherwise provide
    14  special provisions for individuals, corporations, associations
    15  or nonprofit institutions, including nonpublic schools (whether


     1  sectarian or nonsectarian) in order to alleviate the danger,
     2  damage, suffering or hardship faced by such individuals,
     3  corporations, associations, institutions or nonpublic schools as
     4  a result of Great Storms or Floods of September 1971, of June
     5  1972, or of 1974, or of 1975 or of 1976.
     6     (b)  Notwithstanding the provisions of Article III, section
     7  29 subsequent to a Presidential or Gubernatorial declaration of
     8  an emergency or of a major disaster in any part of this
     9  Commonwealth, the General Assembly shall have the authority by a
    10  vote of two-thirds of all members elected to each House to make
    11  appropriations limited to moneys required for Federal or
    12  Commonwealth emergency or major disaster relief. This subsection
    13  may apply retroactively to any Presidential declaration of an
    14  emergency or of a major disaster in 1976 or 1977 and to any
    15  Gubernatorial declaration of an emergency or of a major disaster
    16  subsequent to 1981.
