                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, prohibiting the keeping of nonpet and
     3     nondomestic animals.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5230 of Title 18, act of November 25,
     7  1970 (P.L.707, No.230), known as the Pennsylvania Consolidated
     8  Statutes, is amended by adding a subsection to read:
     9  § 5511.  Cruelty to animals.

    11     (m)  Nonpet or nondomestic animals.--Except as specifically
    12  provided in this subsection, a person commits a summary offense
    13  if he keeps, confines, sells, offers for sale, transfers, gives
    14  or imports into the Commonwealth any animal except a pet or
    15  domestic animal.
    16     This subsection shall not apply to the keeping or confinement
    17  of animals by a State-owned, municipally-owned or privately-
    18  owned zoo or wildlife refuge; the sale, offer for sale, transfer

     1  or gift of any animal to any State-owned, municipally-owned or
     2  privately-owned zoo or wildlife refuge; or the importing of any
     3  animal into the Commonwealth by or for the purpose of keeping by
     4  a State-owned, municipally-owned or privately-owned zoo or
     5  wildlife refuge.
     6     For the purposes of this subsection, "pet or domestic animal"
     7  means any dog, cat, hamster, rabbit, mouse, gerbil, guinea pig
     8  or chinchilla; any equine, bovine or porcine animal; any sheep,
     9  goat, turtle, terrapin, snake, lizard; any canary, parakeet or
    10  other avis raised for food, hobby or sport; and any aquarium
    11  fish; and, "zoo" means a place where an animal, reptile or bird
    12  which is not a pet or domestic animal is kept and is open to the
    13  public at reasonable hours and rates of admission.
    14     Section 2.  This act shall take effect in 60 days.
