                                     AN ACT

     1  Providing for a moratorium on the issuance of permits for
     2     municipal waste disposal facilities.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Definitions.
     6     The following words and phrases when used in this act shall
     7  have the meanings given to them in this section unless the
     8  context clearly indicates otherwise:
     9     "Department."  The Department of Environmental Protection of
    10  the Commonwealth.
    11     "Municipal waste."  The term shall have the meaning given to
    12  it under the act of July 7, 1980 (P.L.380, No.97), known as the
    13  Solid Waste Management Act.
    14     "Municipal waste disposal facility."  A landfill or an
    15  incinerator used or capable of being used for the disposal of
    16  municipal waste.


     1  Section 2.  Moratorium on permitting municipal waste disposal
     2                 facilities.
     3     Notwithstanding any other provision of law, the department
     4  shall immediately cease reviewing applications and cease issuing
     5  permits under the act of July 7, 1980 (P.L.380, No.97), known as
     6  the Solid Waste Management Act, for the construction of new, or
     7  the expansion of existing, municipal waste disposal facilities
     8  until the department has developed, implemented and received
     9  Environmental Protection Agency approval for a State Solid Waste
    10  Management Plan as required by the Federal Solid Waste Disposal
    11  Act (Public Law 89-272, 42 U.S.C. § § 6941 through 6949).
    12  Section 3.  Effective date.
    13     This act shall take effect immediately.
