AN ACT

 

1Amending Title 61 (Prisons and Parole) of the Pennsylvania
2Consolidated Statutes, further providing for parole power.

3The General Assembly of the Commonwealth of Pennsylvania
4hereby enacts as follows:

5Section 1.  Section 6137(e)(3)(i) and (4) of Title 61 of the
6Pennsylvania Consolidated Statutes are amended to read:

7§ 6137.  Parole power.

9(e)  Drug screening tests.--

11(3)  (i)  The board shall establish, as a condition of
12continued parole for a parolee who, as an inmate, tested
13positive for the presence of a controlled substance or a
14designer drug or who was paroled from a sentence arising
15from a conviction under The Controlled Substance, Drug,
16Device and Cosmetic Act or from a drug-related crime, or 
17from a crime of violence as defined in 42 Pa.C.S. § 
189714(g) (relating to sentences for second and subsequent 

1offenses) or any felony conviction, the parolee's
2achievement of negative results in such screening tests
3randomly applied.

5(4)  For a parolee who was not paroled from a sentence
6arising from a conviction under The Controlled Substance,
7Drug, Device and Cosmetic Act or from a drug-related crime, 
8or from a crime of violence as defined in 42 Pa.C.S. § 
99714(g) or any felony conviction, the board may establish, as
10a condition of parole, that the parolee achieve negative
11results in screening tests randomly conducted. The parolee
12shall be responsible for testing costs.

14Section 2.  This act shall take effect in 60 days.
