AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," requiring school courses relating to 6 the cause and prevention of drug and alcohol abuse; mandating <-- 7 AND PERMITTING THE EMPLOYMENT OF a certified addiction <-- 8 counselor be employed by each district; and providing funding <-- 9 BY SCHOOL DISTRICTS. <-- 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 Section 1. Section 1605 of the act of March 10, 1949 13 (P.L.30, No.14), known as the Public School Code of 1949, is 14 amended by adding subsections to read: 15 Section 1605. Courses of Study.--* * * 16 (c) Each student in grades kindergarten through twelve 17 inclusive shall receive a mandatory alcohol and chemical abuse 18 course of study. The course of study shall be developed or 19 approved by the Department of Health, Office of Drug and Alcohol
1 Programs, and shall include, but not be limited to, drug and 2 alcohol information, prevention programming and intervention 3 programming. The course of study may be integrated into existing 4 health instruction courses. 5 (d) In addition to the mandatory course set forth in <-- 6 subsection (c), each SCHOOL BOARDS SHALL CONDUCT AN ASSESSMENT <-- 7 OF THE NEED FOR DRUG, ALCOHOL OR CHEMICAL ABUSE SCREENING AND 8 REFERRAL SERVICES AND SUBMIT A WRITTEN REPORT TO THE SECRETARY 9 OF EDUCATION BY JUNE 30, 1986. BASED UPON THIS ASSESSMENT BY 10 LOCAL SCHOOL BOARDS OF THE NEED FOR SUCH SERVICES, A school 11 district shall MAY have an agreement or contract with or shall <-- 12 employ a person or organization approved by the Office of Drug 13 and Alcohol Programs or a certified addictions counselor to 14 handle screening and referral of students with problems relating 15 to drug, alcohol or chemical abuse. 16 (e) The provisions of subsections (c) and (d) shall be <-- 17 funded by the tax revenues generated by the act of June 9, 1936 18 (Sp.Sess., P.L.13, No.4), entitled, as reenacted and amended, 19 "An act imposing an emergency State tax on liquor, as herein 20 defined, sold by the Pennsylvania Liquor Control Board; 21 providing for the collection and payment of such tax; and 22 imposing duties upon the Department of Revenue and the 23 Pennsylvania Liquor Control Board," or such acts repealing or 24 recodifying the same. 25 (E) FOR PURPOSES OF REIMBURSEMENT, ANY PROGRAMS OR SERVICES <-- 26 DEVELOPED PURSUANT TO SUBSECTION (C) OR (D) SHALL BE CONSIDERED 27 TO BE PART OF ACTUAL INSTRUCTIONAL EXPENDITURES. 28 Section 2.
