In the House of Representatives, December 9, 1975 1 WHEREAS, The General Assembly has enacted the act of June 30, 2 1975 (No.8-A), known as the "General Appropriation Act of 1975"; 3 and 4 WHEREAS, Said act contains therein an appropriation item to 5 the Department of Public Welfare, to wit: 6 For payment of grants to political 7 subdivisions to provide services for the 8 aging, including but not limited to home- 9 making services, community care services, 10 foster care services, protective care 11 services and counseling services .............5,094,000; and 12 WHEREAS, Political subdivisions do not in all cases provide 13 said services; and 14 WHEREAS, The words of this statute are not explicit and the 15 intention of the General Assembly appears uncertain; and 16 WHEREAS, The General Assembly does not intend a result that 17 is impossible of execution; and 18 WHEREAS, The General Assembly intends that the entire statute
1 be effective and certain; and 2 WHEREAS, The result occasioned by the uncertainty of the 3 language is to deny substantial benefits to the aging; therefore 4 be it 5 RESOLVED (the Senate concurring), That the General Assembly 6 of the Commonwealth of Pennsylvania intends that the Department 7 of Public Welfare be authorized to expend said already 8 appropriated amount of money, to wit, $5,094,000, for the 9 purpose of developing, operating and purchasing services for the 10 aging, including but not limited to homemaking services, 11 protective care services and counseling services.
