                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, providing for the State Treasurer to
     3     establish a restricted account for the deposit and
     4     expenditure of maintenance fees collected from residents of
     5     State veterans' homes.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 702 of Title 51, act of November 25, 1970
     9  (P.L.707, No.230), known as the Pennsylvania Consolidated
    10  Statutes, is amended by adding a paragraph to read:
    11  § 702.  Duties of department.
    12     The department shall have the power and its duty shall be:
    13     * * *
    14         (12)  To select, maintain, operate and administer the
    15     Pennsylvania Soldiers' and Sailors' Home or homes wherever
    16     situate.
    17     Section 2.  Title 51 is amended by adding a section to read:
    18  § 705.  Control and use of maintenance fees collected from


     1          residents of State-operated veterans' homes.
     2     (a)  Responsibility for fees.--The department shall receive
     3  and deposit all maintenance fees assessed and collected by the
     4  Adjutant General pursuant to section 902 (10) (relating to the
     5  general powers and duties of Adjutant General) into a restricted
     6  account to be established by the State Treasurer.
     7     (b)  Restricted account.--The State Treasurer shall establish
     8  a restricted account for the deposit of all maintenance fees
     9  collected from residents of veterans' homes by the department.
    10  The restricted account shall contain two separate funds
    11  designated as follows:
    12         (1)  The building fund which shall be utilized to finance
    13     construction, renovations or major maintenance projects at
    14     State veterans' home facilities.
    15         (2)  The operations fund which shall be utilized to
    16     refurbish or replace fixed or nonfixed assets and to provide
    17     for social and rehabilitative health care and equipment at
    18     State veterans' homes.
    19     (c)  Moneys for the special accounts.--The State Treasurer
    20  shall, for each fiscal year, from the moneys deposited by the
    21  department, place a minimum sum of $150,000 into the building
    22  fund. Any amount in excess of the $150,000 shall be placed in
    23  the operations fund. At the conclusion of each fiscal year all
    24  unspent or unencumbered money in the operations fund shall be
    25  transferred to the building fund.
    26     Section 3.  This act shall take effect immediately.
