                                     AN ACT

     1  Amending the act of July 14, 1961 (P.L.637, No.329), entitled
     2     "An act relating to the payment of wages or compensation for
     3     labor or services; providing for regular pay days; conferring
     4     powers and duties upon the Department of Labor and Industry,
     5     including powers and duties with respect to the civil
     6     collection of wages; providing civil and criminal penalties
     7     for violations of the act; providing for their collection and
     8     disposition and providing for additional civil damages,"
     9     further providing for employe rights and notification as to
    10     certain information.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  Section 3, act of July 14, 1961 (P.L.637,
    14  No.329), known as the "Wage Payment and Collection Law," is
    15  amended by adding a subsection to read:
    16     Section 3.  Regular Payday.--* * *
    17     (c)  Shortages.  In case of a shortage in his pay, an employe
    18  shall not be docked for any time spent discussing the shortage
    19  with his employer when the shortage is found to be the fault of
    20  the employer.
    21     Section 2.  Section 4 of the act, amended July 14, 1977
    22  (P.L.82, No.30), is amended to read:

     1     Section 4.  Notification.--It shall be the duty of every
     2  employer to notify his employes in writing at the time of hiring
     3  of the time and place of payment and the rate of pay, an
     4  explanation of all deductions and the amount of any fringe
     5  benefits or wage supplements to be paid to the employe, a third
     6  party or a fund for the benefit of the employe and any change
     7  with respect to any of these items prior to the time of said
     8  change, also, the employer shall explain to the employe, prior
     9  to payday, when the employe is to be deprived of any anticipated
    10  moneys, and the paycheck stub shall indicate the reduction.
    11  Alternatively, however, every employer may give such
    12  notification by posting the aforementioned facts and keeping
    13  them posted conspicuously at the employer's place of business.
    14  Further, in cases where wages, amounts of any fringe benefits or
    15  wage supplements are set forth in a bona fide collective
    16  bargaining agreement and copies of that agreement are available
    17  to employes, then this shall satisfy the employer's duty to give
    18  notice.
    19     Section 3.  This act shall take effect in 60 days.
