AN ACT

 

1Amending the act of November 29, 2004 (P.L.1376, No.178),
2entitled "An act relating to alternative fuels; establishing
3the Alternative Fuels Incentive Fund; authorizing grants and
4rebates to promote the use of alternative fuels; imposing
5duties on the Department of Environmental Protection;
6providing for an annual report; allocating funds collected
7from the utilities gross receipts tax; making an
8appropriation; abrogating regulations; and making a repeal,"
9providing for State government energy efficiency.

10The General Assembly of the Commonwealth of Pennsylvania
11hereby enacts as follows:

12Section 1.  The act of November 29, 2004 (P.L.1376, No.178),
13known as the Alternative Fuels Incentive Act, is amended by
14adding a section to read:

15Section 3.2.  State government energy efficiency.

16(a)  Definitions.--The following words and phrases when used
17in this section shall have the meanings given to them in this
18subsection unless the context clearly indicates otherwise:

19"Department."  The Department of General Services of the
20Commonwealth.

21"Governmental unit."  A department or agency under the

1jurisdiction of the Governor of the Commonwealth.

2"Secretary."  The Secretary of General Services of the
3Commonwealth.

4"State building."  A structure occupied by an executive 
5agency, an independent agency, a State-affiliated entity or a 
6State-related institution as defined in 62 Pa.C.S. § 103 
7(relating to definitions) or by the unified judicial system and 
8its officers.

9(b)  Overall energy reduction target.--On or before December
1031, 2017, the Commonwealth shall reduce its overall use of
11petroleum-based heating and transportation-based fuels by 15%
12from the usage levels existing on June 30, 2010.

13(c)  Reducing energy use in State buildings.--The department
14shall establish an energy efficiency savings program for all
15State buildings managed by the department or another department
16or agency within the executive branch. The program shall include
17reduction of the Commonwealth's petroleum-based energy use in
18all Commonwealth-owned facilities in accordance with the
19requirements set forth in subsection (b). The department shall
20reach this goal by December 31, 2017.

21(d)  Energy efficiency and State motor vehicle fleet.--In
22managing the Commonwealth's fleet of motor vehicles, the
23department shall:

24(1)  Ensure compliance with the requirements of the 
25Energy Policy Act of 1992 (Public Law 102-486, 42 U.S.C. §
2613201 et seq.) by acquiring alternative fuel vehicles.

27(2)  Increase the number of hybrid or other alternative
28fuel vehicles within the Commonwealth vehicle fleet and
29reduce the Commonwealth's petroleum-based transportation
30energy use in accordance with the requirements of subsection

1(b). The department shall ensure that the purchase and
2deployment of the hybrid or other alternative fuel vehicles
3are cost effective and capable of meeting the Commonwealth's
4transportation needs.

5(3)  Increase the use and procurement of alternative fuel
6and bio-based lubricants used within the Commonwealth vehicle
7fleet in accordance with the requirements of subsection (b).
8The department shall conduct an analysis of the vehicle fuel
9and the amount of lubricants used by all fleet vehicles and
10develop a schedule for increasing the amount of alternative
11fuel and bio-based lubricants over this period.

12(4)  (i)  Increase the use and procurement of diesel
13fuel with the highest percentage of biodiesel content in
14the blend that is available. The target shall be to
15increase the Commonwealth's utilization of biodiesel fuel
16as part of its overall effort to meet the requirements of
17subsection (b).

18(ii)  The biodiesel used in the blend shall originate
19from a qualified Pennsylvania-based biodiesel producer.

20(iii)  The requirements of subparagraph (ii) shall
21not apply:

22(A)  to aviation fuel;

23(B)  where prohibited by law; or

24(C)  to any vehicle owned or operated by an
25agency under the Governor's jurisdiction and of an
26independent agency, State-affiliated entity or State-
27related institution for which mechanical failure due
28to the use of biodiesel fuel will void the
29manufacturer's warranty for that vehicle.

30Section 2.  This act shall take effect in 60 days.
