AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," further providing for penalties for
6 defacing, injuring or destroying school property.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 777, act of March 10, 1949 (P.L.30,
10 No.14), known as the "Public School Code of 1949," is amended to
11 read:
12 Section 777. Defacing, Injuring or Destroying Property Used
13 for School Purposes; Penalty.--(a) If any person shall
14 willfully or maliciously break into, enter, deface, or write,
15 mark, or place any obscene or improper matter upon, any public
16 school building, or other building used for school purposes, or
17 other purposes provided for in this act, or any out-house used
18 in connection therewith; or shall deface, injure, damage, or
19 destroy any school furniture, books, paper, maps, charts,
20 apparatus, or other property contained in any public school
1 building, or other building used and occupied for school 2 purposes, or other purposes provided for in this act; or shall 3 injure, damage, or destroy any shade-trees, shrubbery, fences, 4 or any other property of any kind, upon any public school 5 grounds, or upon any public school playground, such person shall 6 be guilty of a misdemeanor, and upon conviction thereof shall be 7 sentenced to pay a fine of not less than [five dollars ($5)] 8 fifty dollars ($50) and not more than [two hundred dollars 9 ($200)] one thousand dollars ($1,000), or undergo an 10 imprisonment in the county jail for a period not exceeding six 11 months, either or both, at the discretion of the court. In 12 addition to any other penalty prescribed by this subsection, the 13 court, upon conviction of a defendant for a violation of this 14 subsection, may order the defendant to compensate the school 15 district for any damages it sustained as a result of the 16 defendant's unlawful conduct. 17 (b) The board of school directors of a school district is 18 authorized to adopt regulations and procedures providing for 19 rewards of up to one thousand dollars ($1,000) to any person who 20 provides information which aids in the conviction of any person 21 for violating the provisions of subsection (a). 22 Section 2.
