AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, further regulating surrender of registration plates
3 and cards.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 1376 of Title 75 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 1376. Surrender of registration plates and cards upon
9 suspension or voluntarily.
10 (a) General rule.--The department, upon suspending any
11 registration, shall require the registration plate or plates and
12 registration card to be surrendered immediately to the
13 department and may delegate authority to any authorized
14 department employee, member of the Pennsylvania State Police or
15 local police officer to seize the registration plate or plates
16 and registration card or cards. The department shall, by
17 regulation, prescribe the manner of selecting the employees and
1 State and local police officers to seize the registration plates 2 and registration cards. 3 (b) Voluntary surrender.--In addition to surrendering the 4 registration plate and registration card in accordance with 5 subsection (a), a person may cancel any insurance policy which 6 satisfied the financial responsibility requirements of Chapter 7 17 (relating to financial responsibility) and may voluntarily 8 surrender the registration plate and registration card for the 9 vehicle or vehicles covered by that policy to an insurance agent 10 or a notary public if that insurance agent or that notary public 11 has been authorized by the department to receive voluntarily 12 surrendered registration plates and registration cards. An 13 authorized insurance agent or an authorized notary public shall 14 return a voluntarily surrendered registration plate and 15 registration card to the person who surrendered them upon proof 16 of financial responsibility as required by Chapter 17. The 17 department shall, by regulation, establish a procedure for an 18 insurance agent and a notary public to obtain authorization to 19 accept, hold and return voluntarily surrendered registration 20 plates and registration cards in accordance with this 21 subsection. 22 [(b)] (c) Penalty.--Any person failing or refusing to 23 surrender to the department, upon demand, any registration plate 24 or card which has been suspended [is guilty of] or failing to 25 surrender voluntarily any registration plate or card in 26 accordance with subsection (b) commits a summary offense and 27 shall, upon conviction, be sentenced to pay a fine of $100. 28 Section 2.
