                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for facsimile bombs.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  Title 18 of the Pennsylvania Consolidated
     6  Statutes is amended by adding a section to read:
     7  § 5516.  Facsimile bombs.
     8     (a)  Offense defined.--A person commits an offense if the
     9  person knowingly manufactures, sells, purchases, transports,
    10  possesses or uses a facsimile bomb with the intent to do any of
    11  the following:
    12         (1)  Terrify, intimidate, threaten or harass an
    13     individual.
    14         (2)  Cause alarm or reaction on the part of any of the
    15     following:
    16             (i)  A public or volunteer organization that deals
    17         with emergencies involving danger to life or property.


     1             (ii)  A law enforcement organization.
     2     (b)  Grading.--An offense under this section is a misdemeanor
     3  of the second degree.
     4     (c)  Definition.--As used in this section, the term
     5  "facsimile bomb" means a device which:
     6         (1)  resembles in appearance and external qualities an
     7     explosive or incendiary device; but
     8         (2)  does not have the capability to cause an explosion
     9     or fire.
    10     Section 2.  This act shall take effect in 60 days.
