AMENDMENTS TO HOUSE BILL NO. 803

1Amend Bill, page 1, line 5, by inserting after "thereto,""

2 in collective bargaining, further providing for definitions and
3providing for deduction of membership dues or political
4contributions; and,

5Amend Bill, page 1, lines 9 through 11, by striking out all
6of said lines and inserting

7Section 1. Section 1101-A of the act of March 10, 1949 
8(P.L.30, No.14), known as the Public School Code of 1949, is 
9amended by adding definitions to read:

10Section 1101-A. Definitions.--When used in this article, the
11following words and phrases shall have the following meanings:

13"Membership dues" shall mean the dues or fees required to be
14paid by an employe to maintain the employe's membership in an
15employe organization.

16"Political contributions" shall mean moneys or funds
17appropriated or to be used for political activities, including
18any of the following:

19(1) Lobbying as defined in 65 Pa.C.S. § 13A03 (relating to
20definitions).

21(2) Electoral activities.

22(3) Independent expenditures on behalf of, or contributions
23to, a candidate, political party, voter registration campaign,
24political committee as defined in section 1621(h) of the act of
25June 3, 1937 (P.L.1333, No.320), known as the "Pennsylvania
26Election Code," including independent expenditures committee or
27in support of or against a ballot measure.

29Section 2. The act is amended by adding sections to read:

30Section 1113-A. Deduction of Membership Dues or Political
31Contributions.--(a) The deduction of an employes' wages by the
32employer for membership dues, a nonmember fee deduction or a
33political contribution shall not be included in the collective
34bargaining between an employer and an employe organization. A
35collective bargaining agreement entered into, renewed or
36extended after the effective date of this section between an
37employer and an employe organization may not contain a provision

1requiring an employer to deduct membership dues or political
2contributions from the wages of its employes.

3(b) An employer shall not deduct a political contribution or
4membership dues from the wages of public school employes except
5as required by a valid collective bargaining agreement entered
6into between a public employer and a representative of its
7employes prior to the effective date of this subsection.
