                       AMENDMENTS TO HOUSE BILL NO. 2525

     1       Amend Sec. 1 (Sec. 102), page 12, by inserting between lines 
     2    4 and 5
     3       "Veterinarian-client-patient relationship."  A relationship
     4    in which:
     5           (1)  the veterinarian has assumed the responsibility for
     6       making veterinary medical judgments regarding the health of
     7       the animal and the need for veterinary medical treatment; and
     8           (2)  the owner or caretaker of the animal has agreed to
     9       follow the instructions of the veterinarian.

    10       Amend Sec. 4 (Sec. 207), page 34, lines 14 through 19, by
    11    striking out all of said lines and inserting
    12           (5) (i)  Each kennel subject to this subsection shall
    13           establish a veterinarian-client-patient relationship.
    14               (ii)  Each kennel subject to this subsection shall
    15           establish a written program of veterinary care, which
    16           shall include a physical examination and vaccination
    17           schedule, a written exercise plan, a protocol for disease
    18           control and prevention, pest and parasite control,
    19           nutrition, emergency care, euthanasia, and regularly
    20           scheduled visits to the kennel. A copy of the program
    21           shall be kept in the kennel records.

    22       Amend Sec. 4 (Sec. 207), page 36, lines 8 through 10, by
    23    striking out all of said lines and inserting
    24           (9)  The floor of a primary enclosure shall be coated
    25       with an impervious material and shall allow for moderate
    26       drainage of fluids. The walls and ceilings of indoor housing
    27       facilities must be impervious to moisture or be replaceable.

    28       Amend Sec. 4 (Sec. 207), page 39, lines 28 through 30; page
    29    40, lines 1 through 30; page 41, line 1, by striking out all of
    30    said lines on said pages and inserting
    31           (3)  The floor of a primary enclosure shall:
    32               (i)  Be coated with an impervious material and shall


     1           allow for moderate drainage of fluids.
     2               (ii)  Be strong enough so that it does not sag or
     3           bend between the structural supports.
     4           (4)  The floor of a primary enclosure may have metal
     5       strand flooring if the following conditions are met:
     6               (i)  The metal strand flooring is coated with a vinyl
     7           type of coating or a coating made of similar material.
     8               (ii)  The coated metal strand flooring shall be kept
     9           in good repair.
    10               (iii)  The coated metal strand flooring shall be made
    11           of mesh construction that does not allow the dog's feet
    12           to pass through any opening in the floor and does not
    13           otherwise cause injury to the dog.
    14               (iv)  The coated metal strand flooring shall be
    15           constructed of sufficient diameter (gauge) to provide a
    16           completely rigid floor area sufficient to support the
    17           weight of dogs housed in the enclosure.
    18           (5)  The floor of a primary enclosure may have slatted
    19       flooring if the following conditions are met:
    20               (i)  The slatted flooring shall be kept in good
    21           repair.
    22               (ii)  The slatted flooring shall be of a construction
    23           that does not allow the dog's feet to pass through any
    24           opening in the floor and does not otherwise cause injury
    25           to the dog.
    26               (iii)  The slatted flooring shall be constructed to
    27           provide a completely rigid floor area sufficient to
    28           support the weight of dogs housed in the enclosure.
    29           (6)  Each kennel under this subsection shall develop,
    30       document, and follow an appropriate plan to provide dogs with
    31       the opportunity for exercise as approved by the veterinarian
    32       identified by the veterinarian-client-patient relationship.
    33       The plan shall include written standard procedures to be
    34       followed in providing the opportunity for exercise, and be
    35       part of the records of the kennel. The plan, at a minimum,
    36       shall comply with each of the following:
    37               (i)  Dogs except bitches with litters shall be
    38           provided the opportunity for regular exercise.
    39               (ii)  The frequency, method, and duration of the
    40           opportunity for exercise shall be determined by the
    41           veterinarian and shall be provided by access to a run or
    42           open area at the frequency and duration prescribed by the
    43           veterinarian. If an exercise area is utilized, it shall
    44           comply with the following conditions:
    45                   (A)  The exercise run must have adequate means to
    46               prevent dogs from escaping.
    47                   (B)  The exercise run fencing must be kept in
    48               good repair and be free of rust, jagged edges or
    49               other defects that could cause injury to the dogs.
    50                   (C)  The exercise run shall be cleaned in
    51               accordance with the requirements under subsection
    52               (h)(14).
    53                   (D)  Dogs must not be placed in the area in a
    54               manner that would cause injury to the dogs.
    55                   (E)  Compatible dogs, as determined under
    56               subsection (h)(4), may be exercised together.
    57                   (F)  Nursing bitches and their puppies shall be
    58               exercised separately from other dogs.
    59                   (G)  Exercise area ground must be solid and

     1               maintainable. Surfaces such as gravel, packed earth
     2               and grass which are solid and maintainable may be
     3               utilized.
     4               (iii)  Forced exercise methods or devices such as
     5           swimming, treadmills, or carousel-type devices are
     6           unacceptable for meeting the exercise requirements of
     7           this paragraph.
     8               (iv)  If, in the opinion of the veterinarian, it is
     9           inappropriate for certain dogs to exercise because of
    10           their health, condition, or well-being, the kennel may be
    11           exempted from meeting the requirements of this paragraph
    12           for those dogs. Such exemption must be documented by the
    13           veterinarian and, unless the basis for exemption is a
    14           permanent condition, shall be reviewed at least every 30
    15           days by the veterinarian. Records of any exemptions shall
    16           be maintained by the kennel.
    17           (7)  Rabies vaccinations may only be administered by or
    18       under the supervision of a veterinarian.
