AMENDMENTS TO HOUSE BILL NO. 27

Amend Bill, page 3, by inserting between lines 20 and 21
(c) Cause of action for damages.--The following shall apply:
(1) If a violation of this section results in injury,
harm or loss to the person or property of the law enforcement
officer or an immediate family member of the law enforcement
officer, the officer or immediate family member shall have a
cause of action to recover damages against the agency
employing the person responsible for the violation.
(2) Sovereign immunity is waived, and the provisions of
42 Pa.C.S. Ch. 85 (relating to matters affecting government
units) or lack of jurisdiction by the Supreme Court shall not
be raised as a defense against a cause of action brought
against an agency under this subsection.
