MEMORANDUM

Posted: May 31, 2017 12:54 PM
From: Senator Kim L. Ward and Sen. Lisa M. Boscola
To: All Senate members
Subject: Veterinary Practice Immunity for Rendering Aid to an Animal

We are introducing legislation to provide Good Samaritan immunity under the Veterinary Medicine Practice Act to anyone rendering aid to an animal that has experienced trauma due to an accident or injury.

It is a 3rd degree misdemeanor for anyone to practice veterinary medicine without a license. This includes treating an injury or physical condition by any method or mode, including using any apparatus upon any animal. If an EMT or firefighter performs CPR on an animal or administers oxygen to one after an accident or fire, he would be in violation of the act. Anyone assisting an animal that has been hit by a car until veterinarian services could be obtained would also be in violation.

Our bill will provide an exemption within the Veterinary Medicine Practice Act for any individual who gives aid in good faith to an injured animal so he or she would not be subject to fines, penalties, and criminal charges levied under the act.

Introduced as SB808
