Subject:	Resolution: Study of Pennsylvania’s Construction Laws

Shortly, I will re-introduce SR 207 of 2013-2014 (cosponsored by Senators Alloway, Smucker and White), as amended by the Senate State Government Committee in December 2013, calling for the Joint State Government Commission to conduct a comprehensive study of the costs and efficiencies of the requirements under Pennsylvania’s public construction laws. The public/private balanced Advisory Committee would be comprised of merit shop and union contractors, construction law attorneys, design industry representatives, public sector representatives, and private sector owners. The Advisory Committee will review 20 PA construction projects, 10 privately bid and awarded, five bid and awarded by the PA Department of General Services and five bid and awarded by school districts, to compare the estimated original costs, bid costs, actual costs, number and amount of change orders, and estimated completion and actual completion dates. Ohio did a similar study, which resulted in changes to the state’s procurement laws that improved flexibility, accountability, transparency, and efficiency of public construction initiatives.
