MEMORANDUM

Posted: February 6, 2017 12:21 PM
From: Senator John C. Rafferty, Jr.
To: All Senate members
Subject: Increasing the Statute of Limitations for Sex Offenses (Civil Actions)

In the very near future, I will be re-introducing legislation (SB 1207) that would increase the statute of limitations for civil actions on certain sexual offenses committed against a minor.

My legislation will increase the statute of limitations for child sexual abuse to allow a victim of abuse, who was under 18 years of age at the time of the offense, to seek civil recourse 22 years after attaining 18 years of age. Current law limits the statute of limitations for civil proceedings to 12 years after attaining 18 years of age.

This legislation will allow the victim to file for damages regardless of whether the individual files a criminal complaint regarding the childhood sexual abuse.

Introduced as SB643
