Subject: Possession of a False Identification Card
 
Under existing law, it is a summary offense for a first violation and a misdemeanor of the third degree for any subsequent violation for any individual under the age of 21 to possess or use a false identification card. However, when an underage person presents a false ID, the liquor licensee or state store clerk has no authority to confiscate the identification.

Soon, I will re-introduce SB399 of last session which would amend Title 18 (Crimes and Offenses) of the Pennsylvania Consolidated Statutes, further providing for the offense of carrying a false identification card. This legislation would allow any person who is authorized to sell liquor or malt or brewed beverages under the Liquor code (state store clerks, beer distributors, restaurants or bars) and who uses electronic scanners to confiscate an identification card when they have a reasonable suspicion the card has not been lawfully issued to the individual. Confiscated identification cards would be forwarded to law enforcement.
