Subject: Lottery Winnings and Individual Income Tax Refunds as Restitution
 
In the near future, I plan to reintroduce two pieces of legislation that would help crime victims collect court-ordered restitution, and I invite you to join me as a co-sponsor of the bills.

In February of 2013, the Restitution in Pennsylvania Task Force issued a report regarding the level of restitution collections in the Commonwealth. The task force was convened by the State Office of Victim Advocate. In seeking to maximize reimbursement of financial losses to crime victims, the task force made a number of recommended changes to state law.

My two bills were recommended by the task force as a means to increasing restitution collection. All too often, victims of crimes must wait long periods of time for court ordered restitution to be paid to them. According to the Administrative Office of Pennsylvania Courts, only 12 percent of victims ever end up receiving their court ordered restitution, therefore many times the victim is never made whole.

My bills would allow both lottery winnings and individual income tax refunds to be intercepted to fulfill any outstanding court-ordered restitution payments to victims.

Description: This bill allows state income tax refunds to be intercepted to pay court ordered restitution payments to victims. This deduction shall be given priority after delinquent state income tax obligations or delinquent support payments.
