Subject: Senate Bill: Title 18 (Crimes and Offenses) – Additional Sentencing Option (Evaluation for Gambling Disorder) for Trespassers at PA Casino on Self-exclusion List
 
In the near future, I plan on reintroducing legislation in conjunction with Senator Sean Wiley, which would amend Title 18 (Crimes and Offenses), Section 3503 (Criminal trespass) by adding a {new} subsection (b.4) (Evaluation for gambling disorder) that provides the court with an additional sentencing provision in relation to a person convicted of subsection (b) (Defiant trespass) or subsection (b.1) (Simple trespass) resulting from a violation of a self-exclusion list established either by the Pennsylvania Gaming Control Board (PGCB) pursuant to the Pennsylvania Race Horse Development and Gaming Act (Gaming Act), Section 1516 (Persons self excluded from gaming activities) or a PA casino. The additional sentencing option provides the court may direct that the person be evaluated in a manner deemed appropriate by the court to determine if the person has a gambling disorder and whether there is a need for counseling or treatment as part of the sentence or preadjudication disposition.

This legislation was introduced during the 2013-2014 legislative session as SB 1488 and was co-sponsored by Senators Fontana, Schwank, Costa, Vulakovich, Farnese, Pileggi and Rafferty.
