Subject: Expansion of Distracted Driving Prohibition
 
In the near future, I plan on introducing legislation which would expand the current law of distracted driving to include using a hand-held mobile. My legislation will prohibit the use of a hand-held mobile telephone while operating a motor vehicle and also establish a fine for such a violation starting at $100 for the first violation, $200 for the second violation and $300 for the third or subsequent violation. In addition, this bill will require that a record of this violation, and also the violation of texting while driving, appear on the driving history record of the person who committed the violation and that record shall be available to any motor vehicle insurer.

With the increase of technology and the use of hand-held mobile telephones, distracted driving has become a public safety issue to motorist, passengers and pedestrians. According to national statistics, in 2011, 3,331 people were killed in crashes involving a distracted driver and an additional, 387,000 people were injured in motor vehicle crashes involving a distracted driver.
