Subject: Paralyzed Veterans' Pension Program
 
In the near future, I intend to introduce legislation amending the Paralyzed Veterans’ Pension Program -- Title 51 (Military Affairs) Section 7702 -- by changing the name of the program from “Paralyzed Veterans’ Pension” to “Amputee and Paralyzed Veterans’ Pension.”

In addition, my legislation will clarify the definition of “amputee and paralyzed veteran” to base eligibility on “the loss, or the permanent and severe or complete paralysis of two or more limbs, defined as having a disability compensation rating of 40 percent or higher in two or more limbs as determined and certified by the United States Department of Veterans Affairs.”

The current language of the Paralyzed Veterans’ Pension program does not mention permanent service-connected disability at any level of rating as an application requirement. As a result of the Commonwealth Court of Pennsylvania’s decision in Presock v. Department of Military and Veterans Affairs, the Paralyzed Veterans Pension costs have tripled. My legislation will define eligibility for the Amputee and Paralyzed Veterans’ Pension in terms that are used by the U.S. Department of Veterans Affairs 38 Code Federal Regulation in determining disability claims.

This legislation is supported by the Pennsylvania Department of Military and Veterans Affairs.
