| In the near future, I plan to introduce legislation amending the Vehicle Code, Title 75 of the Pennsylvania Consolidated Statutes, to authorize overload permits for trucks hauling bulk milk, including condensed and evaporated milk, that do not exceed 95,000lbs. Currently, Pennsylvania dairy operations are at a disadvantage to New York State operations because skim and condensed milk in 95,000 lb gross weight trucks yielding a 60,000 lb. net load, which is legal in New York State, is not legal in Pennsylvania. Without an overload permit, only an 80,000 gross weight truck is legal in Pennsylvania. The weight differential between states forces Pennsylvania dairy operations to put out the bid with smaller loads, requiring the customer to unload more trucks and pay higher hauling costs. As an example, for every 100 loads of milk a New York dairy supplies to the market, Pennsylvania dairies have to supply 135 loads to deliver the same quantity. Ultimately, this hurts our Pennsylvania dairy industry. This is clearly evident by the number of yogurt production facilities that have located to New York State in recent years creating hundreds of jobs and investing millions into their economy. Easing the restrictions and expanding the permitting opportunity for milk haulers would improve and protect Pennsylvania’s dairy farmers and create needed jobs.
