Subject: Creation of the #METOO PA State House Act
 
In the near future, it is my intention to introduce legislation that creates the “#METOO PA General Assembly Act” (Member and Employee Training and Oversight on PA General Assembly Act). This legislation is a necessary response to the #METOO movement, which has sparked a flurry of scandals and sexual harassment investigations throughout state houses nationwide and the U.S. Congress.
My bill – like its U.S. counterpart -- seeks to reform current procedures in the PA General Assembly for the investigation and resolution of allegations of sexual harassment and protections from said harassment.
This legislation would, in effect, be a state-level version of a congressional bill drafted by US Rep. Jackie Speier (D-CA; https://media.nbcwashington.com/documents/FINAL+SPEIER_091_xml.pdf ).
Briefly, this legislation provides for the following:
  • Bans non-disclosure agreements which mask the names of Members of the PA General Assembly who harass;
  • Prohibits any member of the PA General Assembly from paying settlement costs with taxpayer funds;
  • Requires that paid leave or “remote work assignments” be offered to victims during proceedings;
  • Guarantees that a lawyer or “victim’s counsel” be offered to represent victims during proceedings; and
  • Puts in place “reform” procedures for investigation & resolution of complaints, improves training & transparency of sexual harassment prevention & response training in employment.
Title 46 (Legislature) is amended to provide for the “#METOO State House Act” language. It is time for the Pennsylvania General Assembly and its Members to codify procedure, protocol and law that protects Members, staff, and anyone who works in the State Capitol from harassment and provides an outlet for justice.
