Subject:	Co-Sponsorship: MANDATORY REPORTING OF PARENTAL DRUG OVERDOSES

In the near future, I will introduce a legislative proposal which would amend our Domestic Relations Law to mandate the reporting of actual or suspected drug overdoses suffered by the parent, guardian or other custodian of a child. Under this proposal, a health care provider or first responder would be required to immediately report an actual or suspected drug overdose to the appropriate county agency. The term “county agency” is defined in Title 23 to mean a county children and youth social service agency. Accordingly, overdose reports would be reported only if a health care provider or first responder would render emergency medical service, including the administration of Naloxone, for an actual or suspected drug overdose presented by a parent, guardian or other custodian of a child under the age of 18 or by any other person residing in the parent’s household. Such reports would be made in accordance with current mandatory reporting procedures under Title 23. My legislative proposal would define drug overdose as “the intentional or accidental ingestion or application of a drug or other substance in quantities greater than are recommended or generally practiced, and which may result in severe toxicity or death.” I thank you in advance for joining me as a sponsor of this legislative proposal.
