MEMORANDUM

Posted: January 9, 2017 11:42 AM
From: Representative Eddie Day Pashinski
To: All House members
Subject: Prohibit the sale of alternative nicotine products to minors

In the near future I plan to re-introduce legislation (former HB 587 of 2015) to prohibit the sale of alternative nicotine products to minors. Such products would include electronic cigarettes, nicotine gum, and nicotine patches.

Over the last few years, alternative nicotine products, such as electronic cigarettes, have been growing in popularity. Although electronic cigarettes are tobacco-free, these and similar products contain nicotine, which should be kept out of the hands of children. Currently, 41 states and the Virgin Islands have enacted laws to prohibit the sale of such products to minors.

My legislation amends Title 18 (Crimes and Offenses), section 6305 (relating to the sale of tobacco products) to include alternative nicotine products among items prohibited from being sold to individuals under 18 years of age. In addition to electronic cigarettes, my language includes liquid nicotine, nicotine gum, nicotine patches and related items as products prohibited from being sold to minors.

We made great strides during the 2015-16 Legislative Session with the enactment of Act 84. However, it is essential we keep moving forward to ensure adequate regulation of the e-cigarette industry. Protecting our children must be a top priority. Treating the sale of addictive alternative nicotine products like sale tobacco products is another way we can ensure the health, safety and wellbeing of Pennsylvania’s youth. Please join me in co-sponsoring this legislation.
