Subject: Credit Check for Employment (prior HB 1007)
 
I plan to reintroduce legislation that proposes to amend the Human Relations Act to make the credit report requirement, as a condition of employment, an unlawful discriminatory practice.

The proposal establishes exceptions that will allow the credit report to be used as a condition of employment in certain circumstances. An employer may ask for a credit report if the report is required by law, if the position is with a law enforcement agency, if the position involves a fiduciary responsibility or access to customer or employee/employer personal or financial information, or if the position requires access to confidential or proprietary information.

Provisions of this proposal will not apply to employment contracts entered into or renewed prior to the effective date of the legislation.

Similar legislation has been enacted in at least 10 states. Additionally, similar proposals were introduced in 25 other states during the most recent legislative session.
