| In the near future I plan to introduce legislation which would establish a Commerce Division of the Superior Court. This legislation is modeled after the successful Commerce Case Management Program in Philadelphia. The creation of this specialty division within the Court of Common Pleas (CCP) in Philadelphia fostered a specialty amongst judges hearing commerce cases. Over the last decade the result has been effective, efficient and predictable rulings from Philadelphia judges on complex business cases. Commerce Courts at the local level are not isolated to Philadelphia, as other CCPs have established Commerce Courts to handle complex business cases within their jurisdiction. This legislation establishes the Commerce Division at the Superior Court to foster the same specialization at the state level. By establishing Commerce Court with appellate jurisdiction, the commonwealth would be ensuring the same efficient, effective and predictable legal environment throughout the legal process. This division of the Superior Court will be compromised of 2 Superior Court Judges and 3 Senior Superior Court Judges and would have appellate jurisdiction over business cases. These include corporate acquisitions, mergers, dissolution, liquidations, or other matters concerning corporations, limited liability companies, trusts, sole proprietorships and corporate partnerships. By establishing this specialty division of the Superior Court, Pennsylvania takes an important step for growing our economy. History has shown through Delaware’s Court of Chancery and the Philadelphia Commerce Case Management Program, business locates their operations based off the integrity, efficiency and predictability of the legal system. Although companies may not agree with court rulings; by creating a transparent, predictable and efficient process from original trial through appeals, which entrepreneurs can rely on, more job creators will open their business in Pennsylvania. The result of the improvement in our legal system is not only more Pennsylvanian businesses, but more Pennsylvanian jobs.
