| Subject: | Amendment to the State Lottery Law. |
| In the near future, I will introduce legislation proposing an amendment to the State Lottery Law, which would give the Secretary of Revenue (Secretary) the authority to withhold lottery prizes won by convicted sex offenders. Under this legislation, the right of any person to a lottery prize could be withheld by the Secretary, if it would be determined that the winner of a jackpot prize, annuity prize or any other prize of $2500 or more is subject to registration as a sex offender. The Secretary would be authorized to withhold prize winnings from such an offender for a six-month period. Prize winnings could be released before the expiration of the six-month period only if the offender would provide documentation from the court verifying that all court-ordered obligations have been paid, fully. However, if the Secretary would determine that the offender is delinquent in making court-approved installment payments or is in default, payment of the prize winnings would be withheld by the Secretary and forwarded to the court or other issuing authority for credit to the offender’s delinquent or outstanding court-ordered obligations. As provided in the proposal, any winnings remaining after payment of court-ordered obligations would be released by the Secretary. Court-ordered obligations would include all restitution, reparations, fees, costs, fines, and penalties imposed at sentencing.
