Subject: Farm Vehicle Driver Exemption
 
On Tuesday, March 18, 2014, I will be introducing legislation to amend Title 75 (Vehicles) of the Pennsylvania Consolidated Statues, further providing for the requirement for commercial driver's license.

Federal law passed in recent years under MAP-21 provided to drivers of “covered farm vehicles” operated interstate numerous exemptions from the federal commercial truck driver standards, including requirement for CDL. For farm trucks and farm-truck-powered combinations greater than 26,000 pounds, MAP-21 exempts the driver from CDL whenever the truck or combination is operated within the home state regardless of distance from the farm, or is operated interstate within 150 miles of the farm. However, the PA Vehicle Code’s current farm vehicle driver exemption only provides for a distance exemption of 150 miles from the farm, whether the truck or combination is operated intrastate or interstate. This legislation amends the PA Vehicle Code to expand the farm vehicle driver exemption from CDL to be consistent with MAP-21 and will minimize the potential for confusion and inconsistency in interpretation and application of the exemption among enforcement officers, and will carry out the intent of Congress in MAP-21 to reasonably relieve farm drivers of excessive regulatory burdens primarily developed for commercial truck drivers.
