In the near future, I will be re- introducing legislation to establish the Medical Professional Liability Court in Pennsylvania. The court would consist of 18 elected judges and would be serve 3 districts which encompass the entire Commonwealth. The court would have original jurisdiction of all civil malpractice claims against health care providers. The President Judge and judges of the Medical Professional Liability Court would sit as a panel in the appellate division of the court. No judge who previously participated in a case could sit on the appellate panel for that case. Appeals from this appellate division would only be subject to review by the Pennsylvania Supreme Court. The legislation would create the Medical Professional Liability Court Qualifications Commission to evaluate the qualifications of candidates for judge for the Medical Professional Liability Court. Ratings of the candidates would be published in the Pennsylvania Bulletin. The Medical Professional Liability Court Fund would be created to finance the operating and capital expenses of the court. The Fund would collect surcharges on Health Care facilities licenses and professional health care licenses, in addition to fees for violations of the Health Care Facilities Act.
