MEMORANDUM

From: Representative Robert W. Godshall
To: All House members
Subject: Grants Immunity to Trauma Services

I plan to re-introduce legislation which grants limited immunity to physicians and hospital personnel providing trauma services in accredited facilities across our state. Under this legislation, hospitals, trauma centers and the personnel staffing such health care facilities will not be held liable for non-economic and punitive damages when rendering traumatic injury services, if the care is rendered in good faith. As you will also note, this legislation will alleviate the critical problem faced by trauma units struggling to stay in business today. I believe providing a “Good Samaritan” level of protection to these health care providers is prudent, practical and necessary.

Introduced as HB71
